Roos Studios Liability Waiver: I agree not to hold Roos Studios, Joshua Daniel Roos or Elizabeth Lee Roos and its representatives responsible for injuries or accidents in connection with Roos Studios practices or performances on or off-site. If any injury appears serious enough for hospitalization or medical attention, such expense will be borne by the parents or guardian. In case of injury or illness, I grant permission to any available physician to perform emergency treatment for my child(ren)/ward(s) as deemed necessary. I agree that Roos Studios is not responsible for personal items (including instruments and cell phones) broken, brought or left at any Roos Studios teaching facility or event (including but not limited to recitals, performances, etc.). I agree that I will be held financially liable for any damages made by us/minor child/siblings/relatives/visiting friends to Roos Music Inc. property and/or property of vendors or hosts of Roos Studios' events. I understand and voluntarily assume all risks inherent in the nature of this activity and I waive and release all claims, costs, liabilities, expenses and judgements against Roos Studios and its representatives arising out of my participation or my child’s participation in Roos Studios activities. I understand that Roos Studios may use different Media vendors at any event or lesson time. I give Roos Studios permission to use their Media Vendor (including Photographer, Videographer, Website Designer, etc.) and to use, reproduce and publish said images as well. I give consent to Roos Studios to use photos, videos, work samples taken of me or my minor child(ren)/ward(s) at Roos Studios facilities and events for the business websites, newsletters, marketing brochures, recital programs and other social media forums. I hereby grant to Roos Studios, Joshua Daniel Roos, Elizabeth Lee Roos and his/her heirs, legal representative and assignees, successors in interest, those for whom Roos Studios is acting, and those acting with his/her authority and permission, the irrevocable and unrestricted right and permission to copyright, in his/her own name or otherwise, and use, re-use, publish and republish photographic portraits, picture, video, and audio recordings and motion picture footage of student/child(ren)/ward(s) or in which student/child(ren)/ward(s) may be included, in whole or in part, including but not limited to composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with student’s own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium at his/her studios or elsewhere, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever. I also consent to the use of any printed matter in conjunction therewith. I hereby release, discharge and agree to hold harmless Roos Studios/Joshua Daniel Roos/Elizabeth Lee Roos and his/her heirs, legal representatives and assignees, and all persons acting under his/her permission or authority or those for whom he/she is acting, from any liability by virtue of any blurring, distortion, subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy. By entering Roos Studios premises and affiliated events, I hereby grant Roos Studios on behalf of myself, my spouse or my child(ren)/ward(s) in connection with Roos Studios and to use the photograph and/or recording for all purposes, including advertising and promotional purposes, in any manner and all media now or hereafter known, in perpetuity throughout the world, without restriction as to alteration. I waive any right to inspect or approve the use of the photograph and/or recording and acknowledge and agree that the rights granted to this release are without compensation of any kind. I understand that this agreement extends forever into the future and will have full force and legal effect each and every time I or my spouse and/or child(ren)/ward(s) visit Roos Studios, whether at the current location or any other location or facility. The undersigned further expressly agrees that this agreement is intended to be as broad and inclusive as is permitted by the laws of the state and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. In the event a lawsuit is filed against Roos Studios, I agree to the sole and exclusive venue of Orange County, California. I further agree that the substantive law of California shall apply without regard to any conflict of law rules. By signing this document, I understand that I may be found by a court of law to have forever waived me and my spouse and/or child(ren)/ward(s) right to maintain any action against Roos Studios and any released party herein and that I have assumed all risk of damage, loss, personal injury, or death to myself, my spouse and/or my minor child(ren)/ward(s) and agreed to indemnify and hold harmless Roos Studios and Equipment Suppliers from and against any and all losses, liabilities, claims, obligations, costs, damages and/or expenses whatsoever paid, incurred and/or suffered by Roos Studios and all Equipment Suppliers as a result of the participation in activities in or about the facility by myself, my spouse and/or child(ren)/ward(s) and/or claims asserted by myself, my spouse and or child(ren)/ward(s) against Roos Studios and all Equipment Suppliers related to such participation in Activities. I have had a reasonable and sufficient opportunity to read and understand this entire document and consult with legal counsel, or have voluntarily waiver my right to do so. I knowingly and voluntarily agree to be bound by all terms and conditions set forth herein. I have read the above authorization, release and agreement and I am fully familiar with the contents thereof. I represent and warrant that I am full of age, competent to sign this release and have the right to enter into this agreement on behalf of the minor student(s), for whom I am a legal guardian, and myself. By signing this document, I hereby waive and release Roos Studios and any contracted teachers, from any liability for any injuries and illness incurred while my child(ren)/ward(s) under my care or I are on Roos Studios facilities or at Roos Studios events. You MUST be 18 years or older to sign your own waiver. You MUST be the Parent or Legal Guardian to sign for a minor (under age 18).
